FairMCA / Legal
Effective date: October 23, 2026. Version 1.
FairMCA is a service of Fairloan Consultants Inc. ("FairMCA", "we", "us"). Fairloan Consultants Inc., 22 South Ridge Road, Pomona, NY 10970.
Phone: (845) 535-1480. Email: hello@fairmca.com.
Payments are charged by Fairloan Consultants Inc. through our payment provider, Commas, and show on your statement as "Fairloan/Streamline". Our affiliate Streamlined Consultants Inc. runs some of the shared systems behind FairMCA. See section 14.
By starting a review, checking the Terms box, or paying, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use FairMCA.
You are buying FairMCA for your business, not for personal, family or household use. You tell us that you are an owner or an authorized officer of the business, that you can make this purchase for it, and that the business is the one named at sign-up. The price is per business. A second business needs its own purchase.
The review (one time). After you pay, you connect your business bank accounts and add your merchant cash advance (MCA) agreements. - You connect through Plaid, read-only. We can see account details, balances and transactions going back up to 730 days (about two years). We cannot move money. - You upload your signed MCA agreements, or choose "I will send it later", or ask your funder for a copy yourself. - We compare what each agreement allows with what your bank shows the funder took. - We give you a report for each funder: what the agreement allows, what was debited, and the difference.
How fast. We aim to deliver your report the same business day your bank is connected and your agreements are added. If an agreement needs a person to check it, we deliver by the next business morning. A report waits for at least one agreement. A funder with no agreement shows as "waiting for your agreement" and we do not guess.
If we get it wrong. If we find a mistake in your report, or you tell us about one, we will correct it at no charge and tell you what changed.
What the report is. An estimate based on your bank records and the agreements you shared. It is not a legal opinion. Some agreements, including loans, do not include reconciliation, and then the report says so.
The reconciliation request letter. Where your agreement has a reconciliation clause, we give you a prefilled letter. You read it, sign it and send it. We do not send it for you.
What you can buy today: the one-time review ($149 once) and the review + monthly check ($129 today, then $99 a month), both paid up front. The other ways to pay and live monitoring below are coming soon. They are not for sale yet, and this section will apply to them when they open.
The review and the monthly check (per business, covering every agreement):
| Plan | Up front | By business day | By week | Whole contract |
|---|---|---|---|---|
| One-time review | $149 once | $9 a business day for 20 business days ($180 total) | $49 a week for 4 weeks ($196 total) | $199 once: the review now and a final check when your agreements are paid off |
| Review + monthly check | $129 today, then $99 a month, starting 30 days after your first payment | $5 a business day | $27 a week | $599 once, until your agreements are paid off |
Live monitoring (per agreement): $149 a month for the first agreement and $99 a month for each agreement after it. Or $7 a business day, $39 a week, or $899 once for the life of the agreement. Live monitoring starts with the one-time review, which is billed once on its own ($149).
If you bought the one-time review and later want the monthly check, it is $99 a month from the next month, with no second $129.
The course ("What You Signed"): $49 once. It is included at no charge with any paid FairMCA plan.
Pay first. You pay before you connect your bank. Payments are processed by our payment provider, Commas. We do not see or store your full card number.
Non-refundable. Prices are non-refundable once your payment is accepted. That includes the first month of the monthly check and any month already billed. The one exception: if we are unable to deliver any report for your business, we will refund what you paid for that review. The law may also require a refund in some cases, and nothing here takes away a right the law gives you.
The course is the exception. If you bought the course on its own and are not happy with it, email or call us within 14 days of buying it for a full refund.
Taxes. Prices are shown before any sales or service tax. If a tax is required, we will tell you before we charge it.
Price changes. If we raise a price on a plan you are on, we will email you at least 30 days before the new price applies, and you may end the plan first (section 7).
Declined cards. If a monthly charge fails, we try again up to 3 times. After the third failure, alerts pause and we send you a link to update your card. Your plan stays open until you end it or we close it for non-payment.
If you choose the monthly check (or another billing option below), we keep watching your bank account against each agreement you gave us.
What we do. We compare each debit to what the agreement allows. If a funder takes an amount that is different from your agreement, or takes the same payment twice, or takes a payment after a payoff, we alert you. Each month we send a re-check: what you should have paid versus what was taken, with a running total. We also tell you when we find a new recurring debit that looks like a new advance, so you can send us that agreement.
What we do not do. We watch and alert. We do not stop a funder from taking money, we do not contact a funder for you unless you ask, and we do not guarantee that we will catch every difference or catch it on time. Your bank data may arrive late or be incomplete. This is not legal advice. Keep paying unless a lawyer tells you otherwise.
Your choice of billing (per agreement). Where offered, you pick how the watch on an agreement is billed: monthly, weekly, daily, or one price for the whole contract. The price and total are shown before you pay. Weekly and daily options show the monthly total next to the rate. The monthly option is the one we recommend. - A "whole contract" price is one price (or a fixed schedule with the total stated) for watching one agreement until it ends. An agreement ends when the funder's balance is paid in full, or when the agreement is replaced or renewed. A renewal or refinance is a new agreement, with its own price and your new "yes". - For the per-business plans ($199 review and $599 monthly check), "paid off" means every agreement you gave us when you bought the plan has been paid in full, replaced or renewed. An agreement you add later is covered until then too. - Each agreement on live monitoring is billed on its own: $149 for the first and $99 for each one after. Adding an agreement adds its price; the first month shows the exact amount.
Plain version: the monthly check renews every month and keeps charging your card until you end it. We will not stop on our own.
How to end it. Any one of these works, and each stops your billing right away: 1. Email hello@fairmca.com, or reply to any email from us. 2. Call (845) 535-1480.
Ending the plan stops the next charge immediately. We confirm in writing. We keep watching until the end of the period you already paid for, and nothing already charged is refunded (section 5). You can still see your past reports.
If you get texts from us, texting STOP only stops text messages. It does not end your plan. When you text STOP we reply with how to also end the plan.
We do not use the phrase "cancel anytime" because the plan renews until you end it. Ending it is always available to you.
You confirm that: - you have the right to connect the bank accounts you connect and to let Plaid share their data with us, for the business named at sign-up; - you are allowed to share each agreement you upload with us. Some agreements limit who can see them. We cannot tell you whether sharing a particular agreement with us is allowed. We will flag it if we see a confidentiality clause. You are responsible for checking and for any consequences if it is not allowed; - what you tell us is accurate and complete to the best of your knowledge.
You can disconnect your bank at any time by contacting us, or at Plaid's user portal. Disconnecting does not end your plan unless you also end the plan (section 7).
The monthly check only works while your bank is connected. If your link breaks or you disconnect it, we cannot watch your payments, but your plan keeps renewing and you are still charged until you end the plan. We remind you to reconnect (right away, then after 3 days, 7 days, and every week after that). When you reconnect, we check the days we missed. If the problem is on our side or Plaid's side, we do not charge you for the days we could not watch. If your link stays broken for 60 days, we email you to reconnect or end the plan, with a one-tap link to end it.
The report is information. You decide what to do with it. We do not guarantee that any funder will change your payments, pause them, return money, or agree to anything. We do not tell funders anything about you unless you ask us to. "Nothing goes to a funder without your OK."
The review fee covers your report only. If you want us to join conversations with your funders with you, that is a separate service. We quote it for each case before we begin, in writing, with the price, what we will and will not do, and what happens next. It has its own agreement.
The fee for that service is set for each case. It depends on which funders are involved and how much you owe each one. Your written quote shows the total in dollars and how you pay it: part when we start and part when we finish, or in daily or weekly payments toward the fee. You owe nothing for that service until you sign the quote. Nothing is sent to a funder without your approval of that specific message. We are not lawyers and do not give legal advice in that service, and we do not make promises about results. It is not offered in every state. If it is not offered where you are, we will tell you.
If you check the text-message box, you agree to receive texts from FairMCA (a service of Fairloan Consultants Inc.) about your account, such as report-ready notices, reminders, and alerts about your payments. Up to 1 alert text per day plus reminders. Message and data rates may apply. Reply STOP to stop texts, HELP for help. Consent is not a condition of buying anything. If you do not check the box, we use email instead. The exact text of the box is in our SMS consent page. Texts are not sent before 8 a.m. or after 9 p.m. your local time (8 p.m. in Florida).
Our Privacy Policy explains what we collect, how we use it, and who handles it. In short: we use your bank data and agreements only to do your review and your monthly check, we do not sell them, and an AI service reads your agreements to help prepare the report, under business terms that give that service no rights to your content. You can ask us to delete your data (see the Privacy Policy for what we must keep).
Do not upload anything you are not allowed to share, anything unlawful, or anything with malware. Do not try to break or probe our systems. Do not use FairMCA to harass any funder or person. We may close an account that does.
Plain version: we do careful work, but we cannot promise outcomes, and our responsibility for a loss is limited to what you paid us.
If you share a document you are not allowed to share, or give us wrong authority to connect an account, you are responsible for the resulting claims against us, up to what the law allows.
New York law governs these Terms, without regard to conflict-of-laws rules. Any dispute that cannot be resolved by talking to us first will be heard in the state or federal courts located in New York County, New York, and you and we agree to those courts. This does not stop either of us from using small claims court. These Terms do not include arbitration. Please contact us first at (845) 535-1480 or hello@fairmca.com.
