This policy explains how Fairloan Consultants Inc., which runs FairMCA ("we", "us"), handles information when you use FairMCA. FairMCA is for businesses. It is not for personal or household use.
Our affiliate Streamlined Consultants Inc. (the company behind Streamline Finance) runs some of the shared systems behind FairMCA, including where your data is held. Payments are charged by Fairloan Consultants Inc. through Commas and show on your statement as "Fairloan/Streamline". It acts as our service provider for FairMCA. We do not use your FairMCA bank data or agreements for any Streamline product, and nothing from your review is used to pitch you other products, unless you separately say yes.

From you: - Your name, business name, EIN, business address, email, phone number, and whether you are an owner or authorized officer. - The plan you chose and payment status. Your card is handled by our payment provider (Commas). We see the last four digits and card type, not the full number. - The agreements and other documents you upload: your MCA agreements, renewal papers, funder letters. These may include names, signatures, account numbers and terms that funders consider confidential. - Your messages to us, and your consent choices (including your text-message box, with the time and IP address).
From your bank, through Plaid (with your permission): - Business account details (bank name, account type, masked account number), balances, and transactions going back up to 730 days (about two years). For the monthly check, new transactions keep arriving until you disconnect. - Plaid, not us, sees your bank login. We never see or store your bank username or password.
Automatically: - Device and usage data when you use our site (browser type, pages, time stamps, IP address). - We do not use advertising cookies or ad pixels today. If we add them, we will update this policy first.
From referral partners: if a partner sent you to FairMCA, we record who. We do not share your results with that partner.
AI. We use an AI service, Anthropic, to help read your agreements and draft your report. We send it only what it needs for that task. Our business terms with Anthropic give Anthropic no rights to the content we send. Our staff check results where an agreement needs a person's review. The AI does not make decisions about you and does not give legal advice.
We use Plaid Technologies, Inc. ("Plaid") to connect to your bank accounts. When you connect, Plaid collects your bank login and your account data and shares it with us under your permission. Plaid's use of your information is covered by Plaid's End User Privacy Policy: https://plaid.com/legal/#end-user-privacy-policy.
We ask for read-only access to business accounts and request only transaction data. We cannot move money. Our access lasts until you disconnect (for the monthly check) or, for one-time reviews, we remove the connection 30 days after your report. You can disconnect at any time by contacting us or at Plaid's user portal.
We share information only with service providers that help us run FairMCA, and only for that purpose:

We also share information when the law requires it (for example a court order), to protect against fraud or harm, to enforce our Terms, or in a sale or reorganization of our business, in which case the buyer must honor this policy.
We do not sell your information, we do not share it for advertising, and no mobile information (including phone numbers and text-message opt-in data and consent) is shared with third parties or affiliates for marketing or promotional purposes. Text-message consent and phone numbers are never shared with anyone for their marketing.
We do not tell your funders that you used FairMCA. We contact a funder only when you ask us to and approve the message.
We protect your information with encryption in transit and at rest; access limited to staff who need it, with strong sign-in (multi-factor) and logs of access; separation of environments; vendor review of the companies in section 6; software updates; and an incident response plan. We follow a written information security program that applies to all of our shared systems. No system is perfectly safe. If a security incident affects your information, we will notify you and, where the law requires, the authorities, as quickly as we reasonably can, and we notify Plaid as required.
We do not sell personal information and we do not share it for cross-context advertising. If your state gives you privacy rights (such as access, correction, deletion, and the right to know who receives your information), use the contact details in section 1. We will not treat you differently for using those rights. Our service is for businesses; if you are an individual using it for your sole proprietorship, the same rights apply.
FairMCA is not for anyone under 18.
If we make a material change, we email you and post the new date. If a change would use your data in a new way, we ask for your permission first.
